Clearwater Women Charged With DUI Manslaughter for July crash turns herself in.
CLEARWATER — A 28-year-old Clearwater woman is accused of driving drunk when she turned in front of a motorcyclist, causing an accident that killed the man in July, authorities said.
The suspect, of Clearwater, was arrested Thursday and charged with driving under the influence (DUI) manslaughter.

Toxicology tests revealed Smithson had a blood alcohol level of 0.15, nearly twice the limit at which a driver is presumed impaired in Florida, Clearwater police said.
The victim, a 26 year-old man, of Pinellas Park, was pronounced dead at the scene of the July 10 accident on Missouri Avenue.
According to Clearwater police, the suspect was headed south on Missouri when the suspect, who was northbound, turned in front of him.
The suspect turned herself in at the Pinellas County Jail on Thursday. She was released Thursday night after posting bail. In addition to the manslaughter charge, she was cited for failure to yield to oncoming traffic when making a left turn; the least of here worries at this time.
Because this was the woman’s first DUI charge AND she didn’t flee the scene of the accident she faces up to 15 years in prison behind bars. This time would be reduced with a guilty plea, but then again she may be able to beat the charge. Proving guilt in a DUI manslaughter case can be quite difficult because you must show beyond a reasonable doubt that the suspect was in fact driving the car AND he or she contributed to the cause of the accident. For those of you who think this sounds like a simple task for the prosecution, I assure you it’s not. As for the chemical test the above women failed, those results can also be brought into question. No DUI case, whether a death or serious injury occurred or not, is unbeatable.
